Information clause
Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter the General Data Protection Regulation, ,,GDPR"), please be informed the following:
with regard to national and international programmes and to the extent required for the registration of an account as well as for its maintenance and development of the LSI system, the NCBR acts as the personal data controller;
with regard to the data of experts, applicants, beneficiaries and partners of the PO IR programme, the Minister of Development Funds and Regional Policy shall act as the personal data controller, with its seat in Warsaw 00-926, Wsp?lna 2/4. The Minister, as the personal data controller, entrusted the NCBR with the processing of certain personal data in relation to the implementation of the PO IR under the conditions and for the purposes specified in the agreement and empowered the NCBR to further entrust the data previously entrusted;
with regard to the data of experts, applicants and beneficiaries of the PO WER programme, the Minister of Development Funds and Regional Policy shall act as the personal data controller, with its seat in Warsaw 00-926, Wsp?lna 2/4. The Minister, as the personal data controller, entrusted the NCBR with the processing of certain personal data in relation to the implementation of the PO WER programme under the terms and for the purposes specified in the agreement and empowered the NCBR to further entrust the data previously entrusted;
with regard to the data of experts, applicants and beneficiaries of the PO PC, the Minister of Development Funds and Regional Policy shall act as the personal data controller, with it seat in Warsaw 00-926, Wsp?lna 2/4. The Minister, as the personal data controller, entrusted the Centre of Projects for Digital Poland with the processing of certain personal data in relation to the implementation of the PO PC under the conditions and for the purposes specified in the agreement, while the Centre of Projects for Digital Poland entrusted the processing of personal data to the NCBR as the beneficiary, to the extent resulting from the contract on co-financing;

with regard to item 1, personal data are processed in order to maintain a database of candidates for the NCBR experts, to participate in the selection of projects for funding, to perform tasks related to the implementation of the NCBR's rights and obligations under the project funding agreement or decision on project funding in connection with the implementation of the NCBR's tasks under Articles 27-45 of the Act of 30 April 2010 on the National Centre for Research and Development (hereinafter referred to as the ,,The NCBR Act");
with regard to point 2, personal data are processed for the purpose of applying for EU funds and implementing projects, in particular confirming eligibility of expenditures, providing support to beneficiaries, evaluation, monitoring, control, audit, reporting as well as information and promotional activities within the framework of the POIR, as well as for the purpose of recruiting candidates for experts, maintaining and publishing on the NCBR's website a list of candidates for experts and the participation of experts in project selection or exercising the NCBR's rights and obligations under the grant agreement and evaluating the experts' work;
with regard to point 3, personal data are processed for the purpose of applying for EU funds and implementing projects, in particular confirming eligibility of costs, providing support to project participants, evaluation, monitoring, control, audit, reporting as well as information and promotional activities within the framework of the PO WER, as well as for the purpose of recruiting candidates for experts, The list of candidates for experts is to be maintained and posted on the NCBR's website, the participation of experts in the selection of projects or in the implementation of the NCBR's rights and obligations under the co-funding agreement, evaluation of experts' work and experts' accreditation, maintenance and posting on the NCBR's website the list of candidates for experts who received accreditation, conducting evaluations;
with regard to point 4, personal data are processed for the purpose of applying for European funds and implementation of the project ,,e-Pioneer - support for talented programmers in order to solve identified social or economic problems", including eligibility of cost, providing support to the project in question, evaluation, monitoring, control, reporting, as well as information and promotional activities within the framework of the PO PC;
personal data are processed pursuant to Article 6(1)(b) and (c) of the GDPR for the purposes set out in points 7-10 in connection with the provisions of the NCBR Act and the Act of 11 July 2014 on the principles for the implementation of programmes regarding cohesion policy financed in the financial perspective 2014-2020 (hereinafter the ,,Implementation Act");
the provision of personal data is voluntary, but necessary for the above-mentioned purposes;
personal data shall be processed until the completion of the tasks by the NCBR, in accordance with the NCBR Act, and the completion of the documentation archiving;
The recipients of the personal data may be public authorities and entities performing public tasks or acting on commission of public authorities, to the extent and for the purposes that result from the provisions of law, entities providing services necessary for the NCBR to perform its tasks, including: research companies performing evaluation research on commission of the Managing Authority or the Intermediate Body as well as specialist companies performing controls and audits on commission of the Managing Authority or the Intermediate Body. The data may also be transferred to IT partners, entities providing technical or organisational support;
Your rights in relation to the NCBR are: to request access to your personal data, to rectify, erase or restrict the processing of your personal data, and the right to data portability. You can exercise these rights when:
with regard to a request for data rectification: you notice that the data are incorrect or incomplete;
with regard to the request for erasure: when the data are no longer necessary for the purposes for which they were collected by the NCBR; you object to the processing of your data; your data have been processed unlawfully; the data should be erased in order to comply with a legal obligation;
with regard to a request for data processing restriction: you notice that the data are incorrect - you can request the restriction of your data processing for a period of time allowing us to check the correctness of the data; your data have been processed unlawfully, but you do not wish them to be deleted; we no longer need the data, but you may need them to establish, defend or assert a claim; or you object to the processing of your data - until we determine whether the legitimate grounds on our side override the grounds for the objection;
with regard to the request for data portability: the processing of data takes place on the basis of your consent or a concluded contract and by automated means.

personal data will not be transferred to a third country;

Handling accessibility requests and complaints
Anyone is eligible to request that a digital website, mobile application or some element thereof be made accessible. It is also possible to request that the information be made available in alternative forms, such as reading a digitally inaccessible document.
The request should include:
details of the person making the request,
an indication which website or mobile application is in question, and
method of contact.
If the requesting person indicates a need for the information to be received in an alternative form, they should also specify which form ought to be adopted.
The public entity shall comply with the request immediately, which shall not exceed 7 days. If the said deadline is not to be met, the public entity shall immediately inform when it will be possible to comply with the request. The feedback deadline, however, shall not exceed 2 months.
If it is not possible to ensure accessibility, the public entity may propose an alternative means of accessing the information.
Should the entity refuse to comply with a request to provide accessibility or alternative access to information, a complaint may be lodged against such action.

Architectural accessibility
The National Centre for Research and Development, 69 Chmielna Street, 00-801 Warsaw
The headquarters of the National Centre for Research and Development are located in the fifty-three-storey high-rise building named VARSO Tower. The main entrance to the NCBR’s abode is from Jana Pawła II Street with additional entrances located from the side of Chmielna Street and a car-park of the Polish National Railways (PKP).
There are paid parking spaces in front of the building from the side of Chmielna Street, within a paid parking zone.
In the garage of the Varso Place (consisting of Varso Tower, Varso 1 and Varso 2) there is a public, paid parking area. The building entrances consist of a revolving door and an additional swing door. To the side of the swinging door entrance there is an intercom that allows communication with the building security, who are to provide assistance while accessing the main lobby.
The entrance to the building is on the same level as the pavement and does not require the use of steps or a ramp.
The main lobby of the building houses the building reception.
There are six passenger lifts in the main lobby. From level '0' the lifts serve the odd-numbered floors, while the lifts from the mezzanine serve the even-numbered floors.
In order to use the lifts, it is required to obtain an access card at the main reception.
This card allows an access to the 3rd floor, for the NCBR guests, and to the 8th floor for the NCBR+ or Akces guests.
There is access control in the building by means of access cards.
The NCBR reception is located on the 3rd floor adjacent to the lift lobby.
The Varso Place buildings are connected by a retail and service arcade where small shops, service outlets, restaurants and cafes are located. Some of the premises are accessible from street level and some have outdoor gardens.
It is possible to enter the building with a guide dog.
There is no Braille signage in the building, nor is there any contrast or enlarged print signage for blind and partially sighted people.
An online Polish Sign Language (PJM) interpreter is available at the reception and elsewhere - the service is free of charge, but prior notification is required if you wish to use it.
Furthermore, please be kindly informed that in order to facilitate contact for people experiencing permanent or temporary communication difficulties, the National Centre for Research and Development (the NCBR) provides the access to the provision of interpreting services:
PJM (Polish Sign Language),
SJM (Sign Language System),
SKOGN (Way of communication for deaf-blind people),
In order to use the services of an interpreter (PJM, SJM, SKOGN), an entitled person* should apply for the relevant service at least 3 working days prior to the planned visit. Pursuant to Article 30 of the Act on Ensuring Accessibility for Persons with Special Needs of 19 July 2019 (Journal of Laws from the year 2020, item 1062), a person with special needs or their legal representative, upon demonstration of factual interest, has the right to apply to a public entity for architectural or information and communication accessibility to be provided.
The relevant application for accessibility should include:
contact details of the applicant,
an indication of the barrier that hinders or prevents architectural or information and communication accessibility,
an indication of how to contact the applicant,
an indication of the preferred method of accessibility povison, if applicable.

in person: at the NCBR Main Reception, from 8.30 a.m. to 3.30 p.m., 69 Chmielna Street, Warsaw, 3rd floor.
by postal correspondence to the address: The National Centre for Research and Development, 69 Chmielna Street, 00-801, Warsaw with the annotation: Accessibility application.
The NCBR should ensure accessibility (fulfil the request) without undue delay but no later than within 14 days from the date of submitting the application. If it is not possible to meet this deadline,
the NCBR will immediately notify you of the reasons for the delay and indicate a new deadline for providing accessibility, not exceeding, however, 2 months from the date of submitting the request.
If it is impossible or significantly difficult to provide accessibility within the scope specified in the
application, e.g. for technical or legal reasons, the NCBR will immediately notify you of the impossibility of providing accessibility and propose alternative access.
In the event that we do not provide you with the requested accessibility in the manner and within the aforementioned time frame, you have the right to lodge a complaint about the lack of accessibility. The complaint shall be submitted to the President of the PFRON Management Board, within 30 days counted from the expiry of the deadlines referred to above.
